On 4 January 1997, Böhnhardt and Mundlos walked past the guardhouse onto the grounds of the Jena police headquarters at Käthe-Kollwitz-Straße 1, intending to note down the license plates of police vehicles. Mundlos resisted arrest. Andre K. and Robert H. waited in a car in front of the police headquarters. During a search of the vehicle, police seized a blank-firing pistol and a “Gotcha” rifle, and an investigation for trespassing under Section 123 of the Criminal Code was opened. Four days later, Böhnhardt submitted a registration to the Jena city administration for a rally under the motto “For stricter oversight of the police.” Mundlos was listed as the organizer and person responsible. The city of Jena issued a ban on the assembly.
